In November 2020, when as president of the Court he had already become a faithful collaborator of the López Obrador government, the now retired minister Arturo Zaldívar encouraged agreements, under the protection of the Organic Law of the Judicial Branch of the Federation, to expedite investigations against officials in that area, which he now challenges in his own defense and that of two key former operators accused of corruption, harassment of federal judges and illicit enrichment.

According to public documents, the aforementioned law, in force since June 2021, endorses general agreements in force since 2018 so that complaints or anonymous complaints -which must be accompanied, it is established, by sufficient evidentiary elements.

On November 25, 2022, according to the Official Gazette of that date – under the presidency of Zaldívar – it was approved that General Agreement 132 of the Plenary Session of the Federal Judiciary Council (CJF) be added that “in the event that the circumstances of time, manner and place indicated in the complaint or complaint, signs of conduct likely to constitute administrative responsibility are noticed, investigations may be ordered”, which are regulated by article 118 of that same agreement.

Consultations carried out by this columnist in the field of federal justice show that contrary to what Zaldívar Lelo de Larrea alleges about an “unprecedented” and “violatory of all regulations” situation, during his presidency in the Court only 283 anonymous complaints were reviewed. between 2019 and 2022 against judges, magistrates and ministers. The period of greatest confrontation in the plenary session, the admitted complaints skyrocketed: In 2019 there were 31; in 2022, 38; in 2021, 138, and in 2022, 76.

Between 2018 and 2024, 363 investigations have been initiated against minister-presidents following anonymous complaints. During the administration of Luis María Aguilar, Zaldívar’s predecessor, 11 complaints of this type were processed; with this one, 283, and with the current president, Minister Norma Lucía Piña, the figure is 68.

I share with you today the central document of the investigations announced last Thursday, against Zaldívar, close collaborators and other public actors. They may end up uncovering a corrupt structure that included federal government officials, the Federal Prosecutor’s Office, the Court and the CJF, but also law firms, which acted in collusion to use criminal law to extort or protect businessmen. and politicians depending on their closeness to the regime, or their willingness to pay multimillion-dollar figures for the favors of a mafia.

One of the arms of this operation was located in the CJF, whose president is also the president of the Court. For years, the accusations multiplied around two senior officials appointed by Zaldívar: the general secretary of the CFE presidency, Carlos Antonio Alpízar Salazar, and the head of the Executive Secretariat of Discipline, Jaime Santana Turral, among others. According to the complaints, it was their responsibility to intimidate federal judges to endorse the agreements that were made to reward or punish the actors subject to extortion.

9It is known that in January 2022, after taking office as the new president of the Judicial Branch of the Federation, the first act of Minister Norma Piña was to summon Alpízar Salazar to her office to terminate him suddenly…, although he was almost immediately sheltered by the then Secretary of the Interior, Adán Agusto López – next multi-member senator for Morena. Zaldívar Lelo de Larrea has been described as a liar and cynic. A toxic legacy of the López Obrador administration on the presidential campaign of Claudia Sheinbaum, who had to come out to defend him and describe the accusations against him as political.
