Judge stops transfer of resources from trusts of the Judicial Branch to the reconstruction of Acapulco – El Sol de México

The Ninth Federal District Judge in Administrative Matters of Mexico City, Elízabeth Trejo Galvánordered this Wednesday not to use the 15.8 billion pesos of the 13 trusts of the Judicial Branch that were liquidated two weeks ago by the majority of the parliamentary groups of Morena and its allies in the Congress of the Union.

The magistrate Froylán Muñoz Alvaradonational director of the National Association of Magistrates and District Judges of the Judicial Branch of the Federation (JUFED), announced this suspension.

In a message at the Federal Court of Justice of San Lázaro, the magistrate pointed out that this includes declaring the nullity of the negotiation that President Andrés Manuel López Obrador was going to start with the Minister President of the Supreme Court of Justice of the Nation (SCJN). ), Norma Piña, to use the resources of said trusts for the reconstruction of Acapulcoafter its devastation by the impact of Hurricane Otis.

“Today, the federal judges notify civil society and all personnel who work for the Federal Judiciary, that in the indirect protection trial number 1754/2023, promoted by the representation of this Association, a federal judge with constitutional jurisdiction in Mexico City, has granted the provisional suspension of the Decree that proposes eliminating the trusts of the Judicial Branch of the Federation, by adding a second paragraph to article 224 of the Organic Law of the Judicial Branch of the Federation, published on October 27 of the current year in the Official Gazette of the Federation,” the magistrate stated.

The matter will now be resolved through a trial, and not through a majority agreement or any political approach.

He stressed that in said ruling, with all certainty, “the violations of the legislative procedure through which this decree was approved, the violations of the principles of judicial independence and autonomy, division of powers, progressivity, social security and labor rights acquired in favor of the workers of the Federal Judiciary.”

The judge also announced that the JUDEF is analyzing the possibility of presenting another injunction, in this case “against the approval of the 2024 Federation Expenditure Budget, once – it stated – “the budget adjustments made by the Chamber of Deputies violate financial autonomy and, therefore, consequently, the independence of the Judiciary.”
