In response to a challenge presented by Morena’s representation before the General Council of the National Electoral Institute (INE), the magistrates agreed in a private session to revoke the precautionary measures issued on October 16 by the Complaints Commission of the electoral referee that They limited tours to closed places and with assistance to militants.
The above, because they considered that the Complaints Commission incurred an “undue generalization” when analyzing only two events of the 13 reported by Movimiento Ciudadano, and because they did not find evidence to determine that there was attendance of the general public.
“The fact that some of the events were held in open spaces or in squares that are usually public does not necessarily allow us to conclude that they were events aimed at citizens in general, since it is common for them to be used public spaces for private eventscoupled with the fact that there is not enough evidence in the record to preliminarily maintain that they were indeed directed to the general public,” the ruling dictates.
