The legal problems began in May, the month in which a jury trial on Masimo’s accusations against Apple took place in a federal court in California, which stalled and concluded with a mistrial.

For its part, Apple counterattacked Masimo, accusing them of patent infringement in a federal court in Delaware and arguing that what the healthcare company is really looking for is to make its own smart watch, leaving aside the Apple Watch.

In October, the United States International Trade Commission (ITC) ruled that Apple had violated Masimo Corporation’s patents with the creation of the Apple Watch Series 6, which has technology to read blood oxygen levels, including a pulse oximetry function from the model mentioned below. For this reason, the technology company was prohibited from importing and selling the Apple Watch.

Faced with such a situation, Apple had to stop the sale of Series 9 and Ultra 2 smartwatches in the United States. However, after the ITC ruled in favor of the healthcare company, Apple went to the United States Court of Appeals for the Federal Circuit, a move that was successful, as this Wednesday the import ban on some versions of the Apple Watch was suspended. . This was facilitated after last Tuesday, Joe Biden’s Government refused to veto said ban.

What is pulse oximetry and what does Apple say about it?

According to the University of California San Diego, pulse oximetry is a test used to measure the level of oxygen in the blood. Emphasizing that it really is a very simple procedure, since it is a simple and painless measurement.
